GENERAL TERMS & CONDITIONS

​The following terms and conditions shall form an integral part of the travel contract entered into between a participant and Avus Solutions – Andrej Zupančič s.p., Naredi 13A, 1314 Rob, Slovenija, also known as Moto Time (hereinafter referred to as Moto Time), which the customers conclude with Moto Time as the tour operator directly. Nevertheless, terms and conditions mentioned separately in different travel offers take priority. Please read the terms and conditions carefully for every tour.

General Terms and Conditions – Tours

Booking and Payment

By signing up for the tour, Moto Time offers a participant a binding travel contract. Moto Time cannot accept a participant without a signed contract that is binding on both parties, a participant and Moto Time. The contract comes into force after written confirmation of the tour by Moto Time. Upon registration, payment of the tour in the amount of 100% of the value per a participant is required. This payment guarantees a place on the tour. Spots on the guided tours are limited and reservations are made on a first come basis.

Tour Prices and Price Changes

The tour prices stated on the website are based on the choice of accommodation (double or single room, single room for an extra charge). A participant traveling alone pays the price for the tour for single room. If a solo traveler's booking includes a request to share a double room with another solo traveler, Moto Time will make every effort to find a suitable roommate for that person. In cases where this proves to be impossible, a supplement for a single room will be charged.

Prices quoted by Moto Time are those in effect at the time of publication. In rare cases, due to situations beyond Moto Time's control, Moto Time reserves the right to change tour prices at any time up to 60 days prior to the start of the tour. Moto Time reserves the right to correct calculation errors at any time.

Loyalty Discount

Every trip you take with Moto Time will give you a 50 EUR discount on every future trip with Moto Time. This discount is valid for drivers and passengers who take trips lasting at least 7 days.

Two Tours in One Season Discount

For participating in two trips in one season, Moto Time offers you a 100 EUR discount on the second trip. The discount is not cumulative with the early bird discount (you choose between the early bird discount or the second trip discount in the season).​

Motorcycles

Participants participate Moto Time tours with their own motorcycle and are responsible for ensuring that motorcycles are in legal compliance and in perfect technical condition. A participant is obliged to reimburse Moto Time for all damages that would occur as a result of non-compliance with this provision. Any additional costs incurred (e.g. for the transport of a non-working motorcycle, repair of technical defects, etc.) are paid by a participant himself.

Passport, Visa, Driving License and International Driving License

A participant undertakes to have valid documents, necessary to participate in the tour. An identity card or passport valid at least until the end of the trip, a visa (where necessary), a national driver's license and an international driver's license (if necessary).

A participant is responsible for complying with the passport and visa regulations of the relevant visiting country and assumes full responsibility for the consequences arising from non-compliance.

By signing the contract, a participant declares that he has a valid driver's license for the duration of the tour and a valid traffic permit for the motorcycle used on the tour. A participant must notify Moto Time without delay of any changes regarding his driver's license that affect a participation in the tour (e.g. revocation of driver's license, etc.). If, after the reservation and before or during the tour, it turns out that a participant does not have a valid driver's license, Moto  Time is released from the obligation to continue fulfilling the contract by charging the cancellation costs specified in these conditions. In this case, Moto Time reserves the right to exclude a participant from the tour. Moto Time has no obligation to reimburse the cost of any paid service and is not responsible for any additional costs that may arise as a result of this circumstance.

Change of Participant

A participant of the tour can only be changed with the consent of Moto Time and if the substitute person meets all the conditions for participation in the tour. The transferring person and the replacement person are jointly responsible for the additional costs incurred by the transfer.

Cancellation Charge

In the case of a participant canceling the booking after confirmation, Moto Time reserves the right to charge the cancellation fee based on the time of the cancellation.

Moto Time is not required to refund the purchase price of the tour once the trip has begun, regardless of the reason why a participant is unable to complete their tour.

Tour Services

Moto Time is responsible for providing the services listed in the tour descriptions in accordance with local standards. In case of non-performed or inadequately performed service, a participant must immediately notify Moto Time on the spot.

 

Situations and events beyond Moto Time's control (force majeure) may occur (eg road works, road closures, hotel closures, natural disasters or bad weather, government orders, strikes, riots, war or war-like conditions, epidemics, etc.), making it necessary for Moto Time to postpone or cancel the tour, change the itinerary or change hotels, cities and other travel arrangements. Moto Time reserves the right to withdraw without notice any part or the entire tour or to make necessary changes, and additional costs, if necessary, will be paid by the customer. In these cases, Moto Time accepts no responsibility or liability for any loss, expense or inconvenience incurred by a participant.

Local Provisions

A participant participates in the road traffic of the travel countries at his own risk and undertakes to observe the provisions of local traffic regulations. If a participant does not respect traffic regulations, Moto Time reserves the right to withdraw from the contract. All traffic fines, administrative fines or similar sanctions and compensation for the legally protected interests of third parties arising from non-compliance with local traffic regulations shall be paid by a participant.

Own Responsibility and Ability To Drive

Moto Time sets a tentative itinerary, which a participant must follow at his own risk, and a participant is obliged to adapt his driving method to the prevailing circumstances and his driving ability. If a participant cannot follow the travel plan, he must stop and inform the guide immediately.

Moto Time tours are attended by a variety of participants. The driving skills of individual participants vary, of course, and a participant undertakes to treat other participants with consideration and tolerance. If a participant does not have the necessary ability to ride and does not have full control of the motorcycle to ride safely, Moto Time is released from the obligation to fulfill the contract. In this case, Moto Time reserves the right to exclude a participant from participating in the tour.

Customer's Conduct and Liability

Participants undertake not to cause damage to nature or third parties with their actions while riding a motorcycle. Participants agree to obey local traffic laws and practice safe group travel practices as described by the tour leader and Moto Time guidelines. In the event that a participant repeatedly ignores the rules or causes others to feel threatened by their actions, Moto Time reserves the right to cancel this agreement and remove a participant from the tour. A participant is responsible for all personal and material damage that he/she culpably causes.

A participant must not consume alcohol or take drugs or other substances that affect the ability to drive while riding, until the motorcycle is parked for the night. This also applies to participants who take part in the trip as fellow passengers. In case of non-compliance, Moto Time reserves the right to cancel the contract and remove a participant from the tour.

Moto Time is free from the obligation to fulfill the contract if, despite a warning in the context of a guided tour, a participant permanently obstructs the execution of the tour by grossly inappropriate behaviour or if a participant is unable to drive. In this case, a participant is obliged to compensate Moto Time for the damage.

It is agreed and understood that Moto Time, its agents and tour guides are not custodians of the participant's safety and cannot be held responsible in any way for any event related to any activity related to the tour that may result in the event of injury, death or other damage to a participant, his property, his family or heirs. Moto Time is not responsible for any damage caused to third parties due to a participant's activities during the tour.

Weather Conditions

Moto Time tries to plan its tours at times when the weather conditions in the individual tourist regions are favorable for motorcycling. Many tours pass through areas where weather conditions can change suddenly. Moto Time assumes no responsibility for any adverse weather conditions; in this case, a participant is not entitled to reimbursement of travel expenses.

Data Protection and Copyright

The photographs and videos produced by representatives of Moto Time during the tour are the property of Moto Time under copyright law. Moto Time shall be entitled to use this material for marketing and advertising purposes, including the images in which the participants can be recognized. Participants who submit their photographs to Moto  Time agree to allow the use of their photographs by Moto Time, for marketing and advertising purposes.

Miscellaneous

Moto Time recommends taking out appropriate travel, health and accident insurance, as well as tour cancellation insurance.

It is recommended that a participant does not bring items of special value on the tours. Furthermore, it is recommended that a participant take care of their personal belongings. Moto Time is not responsible for lost or stolen items, motorcycles and their cases.

A participant is fully aware of the risks and dangers associated with outdoor activities such as swimming, rafting, climbing or any other activity that may be proposed as a complementary activity on the tour, and accepts full responsibility for participating in the activities.

Verbal agreements with Moto Time are only valid if they have been subsequently confirmed in writing by Moto Time.

Applicable Law

The contractual relationship of the customer with Moto Time shall be governed by Slovenian law.

All disputes arising from this agreement will be solved by the court of law in Ljubljana, Slovenia.
